NEITHER I NOR SIMON IS COMMITTED TO AN EMPLOYMENT RELATIONSHIP FOR A FIXED
PERIOD OF TIME.
EMPLOYMENT WITH SIMON IS AT-WILL. BOTH I AND MANAGEMENT HAVE THE RIGHT TO
TERMINATE THIS EMPLOYMENT AT ANY TIME FOR ANY REASON.
THE LANGUAGE USED IN THE GUIDELINES AND ANY VERBAL STATEMENTS OF MANAGEMENT
ARE NOT INTENDED TO CONSTITUTE A CONTRACT OF EMPLOYMENT, EITHER EXPRESS OR
IMPLIED, NOR ARE THEY A GUARANTEE OF EMPLOYMENT FOR ANY SPECIFIC DURATION.
I UNDERSTAND THAT NO REPRESENTATIVE OF SIMON, OTHER THAN THE CEO/PRESIDENT,
HAS AUTHORITY TO ENTER INTO AN AGREEMENT OF EMPLOYMENT FOR ANY SPECIFIED
PERIOD AND SUCH AGREEMENT MUST BE IN WRITING, SIGNED BY THE CEO/PRESIDENT AND
ME. WE HAVE NOT ENTERED INTO SUCH AN AGREEMENT.
THE GUIDELINES CONTAINS POLICIES ON SEXUAL HARASSMENT AND HARASSMENT, AS WELL
AS HARASSMENT REPORTING PROCEDURE WHICH INCLUDES SPECIFIC PROCEDURES FOR
REPORTING COMPLAINTS TO SIMON MANAGEMENT. I WILL ABIDE BY THOSE POLICIES AND
REPORT IMMEDIATELY ANY COMPLAINT I MAY HAVE OR RECEIVE.
I UNDERSTAND THAT THE CONTENTS OF THE GUIDELINES ARE SUMMARY GUIDELINES FOR EMPLOYEES AND THEREFORE NOT ALL INCLUSIVE. THE ELECTRONICALLY PUBLISHED GUIDELINES SUPERSEDES ALL PREVIOUSLY ISSUED EDITIONS. NO ORAL STATEMENTS OR REPRESENTATIONS CAN CHANGE THE PROVISIONS OF THE HANDBOOK OR ANY SUPPLEMENT. EXCEPT FOR THE AT-WILL NATURE OF EMPLOYMENT, SIMON RESERVES THE RIGHT TO SUSPEND, TERMINATE, INTERPRET, OR CHANGE ANY OR ALL OF THE INFORMATION IN THE GUIDELINES, ALONG WITH ANY OTHER PROCEDURES, PRACTICES, BENEFITS, OR OTHER PROGRAMS OF SIMON. THESE CHANGES MAY OCCUR AT ANY TIME, WITH OR WITHOUT NOTICE.
